If you are considering filing for Chapter 7 bankruptcy, you must pass the bankruptcy means test. The means test looks at your income, and in some cases, your expenses and debts, to determine whether you could afford to pay back some of your debts. If so, you would not be allowed to use Chapter 7, instead you will have to use Chapter 13 if you want to file for bankruptcy.

The table below uses the current applicable income standards and family size to help determine your eligibility. You will still have to supply your financial information during the process of filing for bankruptcy, however the table below gives you a general idea of whether you pass the bankruptcy means test.

Before making any final determinations or taking any further steps on your own, we strongly recommend scheduling a free consultation with a bankruptcy attorney who will be happy to help you to understand all of the options available to you. A free consultation costs you nothing, and is invaluable in weighing all of your options before making any important decisions relating to bankruptcy.

Note. The means test is but one of several hoops you must jump through. Even if your income is low, a judge can prevent you from filing Chapter 7 if it appears that you have enough income to repay a substantial portion of your debts in a 3-year Chapter 13 plan.
